Personal data processing

The data controller is Scandinavian Express Poland Sp. z o.o. with its registered office in Gdansk, ul. Budowlanych 19, registered in the Register of Entrepreneurs under the KRS number 0000173822, NIP: 9570000912, REGON: 190972974. Data protection is carried out in accordance with the requirements of applicable law, and the data is stored on secured servers. Personal data is processed by the Data Controller solely for the following purposes:

  1. conclusion and performance of the contract for the provision of services in accordance with the General Terms and Conditions of Service Provision of Scandinavian Express available at www.scandinavian.com.pl/dokumenty/
  2. marketing purposes (based on consent given), including sending electronic messages containing marketing and commercial information.

The provided personal data will not be disclosed to other entities, except for entities with whom we closely cooperate (data processing agreements) and those who have the appropriate legal basis.

The Data Controller takes due diligence to ensure the appropriate security of the transmitted personal data, in particular against unauthorized access, in accordance with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

The IT system in which personal data is processed meets the requirements of the Regulation of the Minister of Internal Affairs and Administration of 29 April 2004 on documentation of the processing of personal data and the technical and organizational conditions that should be met by devices and IT systems used for the processing of personal data (Journal of Laws No. 100, item 1024).

Personal data is processed in accordance with the principles of lawfulness, confidentiality, accountability, adequacy, and reliability.

The Data Controller applies different retention periods for personal data processing depending on the legal basis:

If the legal basis for processing personal data is consent for marketing purposes (e.g. newsletter), then personal data is processed until the consent is withdrawn. After the withdrawal of consent, for a period of time corresponding to the statute of limitations for claims that may be raised against the data controller and that may be raised by the data controller. Currently, this period is 10 years.

If the basis for data processing is the performance of a contract, then we process the data for as long as necessary to perform the contract, and after that period for a period corresponding to the statute of limitations for claims that the data controller may raise or that may be raised against the data controller. In the case of entrepreneurs, this period generally does not exceed 3 years and may vary depending on the type of contract for which the data processing was carried out.
If there are specific regulations specifying the period for which personal data should be retained, such regulations may extend or shorten the processing period for personal data in specific cases.

If the basis for processing personal data is consent given in connection with the recruitment process, we process the personal data until the recruitment process is completed. In the case where a candidate gives explicit consent for the processing of their data for future recruitment purposes, their personal data will be processed for a period not exceeding 1 year.

At any time, it is possible to withdraw consent or object to the processing of data for marketing purposes and consent to receiving commercial information.
Everyone whose data we process (if we are the data controller) has the right to access, rectify, erase or restrict the processing of their data, the right to object, and the right to lodge a complaint with a supervisory authority.
We reserve the right to process data after termination of the Agreement or withdrawal of consent only to the extent necessary to pursue potential claims before a court or if national, EU or international law requires the data controller to retain the data.
